What is product liability?
Product liability law is part of a larger body of law called personal injury law. Product liability is the responsibility of manufacturers, distributors, and sellers of products to the public to deliver their products free of any defects which may harm people, and if injury, harm, or even death results from the use of the product, to be responsible for the victim’s damages, such as medical expenses, lost wages, pain and suffering, and property damage.
There is no federal products liability law and every state has its own laws based on various theories such as, negligence, breach of warranties, or strict liability. Most states, including New Jersey, base their laws on Article 2 of the Uniform Commercial Code.
There are three major types of product liability claims:
- A manufacturing defect, which occurs in the manufacturing process and usually involves the use of poor quality materials or shoddy workmanship
- A design defect, where the product design is inherently dangerous no matter how carefully it is manufactured
- A marketing defect, meaning the failure to warn the public of any possible harm that could be prevented with proper warning and instructions
